Mediation Rates
Our hourly rate is $245.00 per hour per party, four (4) hour minimum (Half Day), or eight (8) hour minimum (Full Day). Cancellation of reserved time required 72 business hours (3 business days) in advance or reserved time will be charged as reserved unless time can be filled with another mediation. Invoices will document time incurred in increments of a tenth of an hour and will reflect all time and costs incurred, including telephone conferences, document review, travel or travel related expenses (no travel time invoiced or charged) and appearances at Mediation.
On all cases, there is no charge for administration, routine preparatory or follow up telephone calls. There is never a charge for other additional services without the prior consent of the parties.
There is no charge for travel time. There may be additional fees for air fare or other transportation, lodging, and per diem, as appropriate.
Fees must be deposited in advance and may not be refunded if the mediation is cancelled or taken off calendar within 14 days of the scheduled date.
Mediation Briefs
Mediation briefs are recommended to be served at least seven days prior to the mediation. The briefs should be served on all parties to the mediation. However, the parties can also serve a supplemental “confidential brief” to the mediator within two days of the mediation. The mediation briefs can be in letter or pleading form. Please provide a factual and procedural history of the case, the plead causes of action, and any statutory or case law explaining your position. It is helpful for the mediation process if all clients are provided with the opposing parties briefs prior to the mediation.
It is important for the parties to discuss who will be in attendance at the mediation, prior to the mediation. As a general rule, the mediation is most productive if counsel and the client, or an authorized representative of the client with settlement authority, are present at the mediation.
Arbitration Briefs
Arbitration briefs are required to be served on all parties seven days prior to the arbitration. The arbitration brief should be in the same format as a trial brief. The brief should address key facts, issues of law, and any evidentiary issues to be addressed at the arbitration.
